HBS Terms of Service

These terms cover HBS, the broadcast studio published by Hostreck Inc. Installing or using it means accepting them. They are written to be read once, in plain language, rather than to be impressive.

1. What you are getting

HBS is software that runs on your own computer. Hostreck grants you a personal, non-exclusive, non-transferable licence to install and use it on machines you control, for your own broadcasts or those of the organisation you run them for, commercial or otherwise. The software is licensed, not sold; Hostreck keeps ownership of it.

2. What not to do with it

• Do not resell, rent or redistribute HBS as your own product.
• Do not remove or work around the parts of it that identify Hostreck, then pass the result off as something else.
• Do not use it to broadcast material you have no right to broadcast, or anything unlawful where you are.
• Do not use its YouTube features in ways that break the YouTube API Services Developer Policies or the YouTube Terms of Service.

3. Your Google and streaming accounts

HBS acts on your channel only with permission you grant through Google's own sign-in, and only for as long as you leave that permission in place. You are responsible for the accounts you connect and for what gets published through them. What HBS reads and where it keeps your sign-in is set out in the privacy policy, which is part of these terms.

Signing in to YouTube through HBS also means agreeing to the YouTube Terms of Service linked above.

4. Services and hardware that are not ours

YouTube, Twitch, Facebook, Kick and any RTMP endpoint you configure are run by other people. So are the NDI runtime and the Blackmagic DeckLink drivers HBS can fetch for you at your request, each under its own licence and privacy policy. Hostreck does not control any of them, cannot promise they will be available, and is not responsible for what they do — including a platform rejecting, interrupting, age-restricting or removing your stream.

6. No warranty

HBS is provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. Hostreck does not warrant that the software will be uninterrupted, error-free, or that it will work with every combination of hardware, driver and operating system in existence.

7. Limitation of liability

To the fullest extent the law allows, Hostreck is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost revenue, lost donations, lost recordings, lost data, or a broadcast that failed or was interrupted, arising out of or relating to your use of HBS. Where liability cannot be excluded, it is limited in total to the greater of what you paid Hostreck for HBS in the twelve months before the claim, or CAD $100.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. The rest still does.

8. Updates and changes

Releases may add, change or remove features. Hostreck may stop publishing HBS, or a version of it, at any time. Nothing here obliges us to keep a particular feature, or a particular platform integration, working forever — third parties change their APIs and we follow.

These terms may change. The date at the top moves when they do, and continuing to use the software after that is how the new terms are accepted. If you do not accept them, stop using HBS and uninstall it.

9. Ending this

You end it by uninstalling. Hostreck may end your licence if these terms are broken in a way that is not put right after being pointed out. Sections 6, 7 and 10 survive the ending.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Ontario have jurisdiction, and both sides accept it.
